Is a duplex with multiple units allowed?

What is the authority supposed to review? We are submitting an application for exemption from approval and are building without a building permit. I will announce to the building authority again in advance when handling the special permit what exactly I want to build. If my project does not qualify as a single-family house, I will have them explain why, how, and for what reason. I do not intend to build anything illegal.

And we won’t fully exploit the 0.4 floor area ratio anyway, since we will build the garages where they can be placed best and most effectively. That means a lot more green and unsealed area around the house.

Thank you for that. But even here, as is usually the case, there is a dispute about residential units, especially about the historic two-apartment clause. However, your development plan is current and contains no statements regarding apartments or residential units. I do not understand where Yvonne’s doubts come from. Oh! But that does not fit with this statement: If that is possible, you can count yourself lucky to have a very developer-friendly building authority. Whether the requirements of §63 Building Code NRW are fulfilled. With the planned location of the double garage, they are not.

The discussions with the building authority have been productive and friendly so far. It was said that on the right (south) side of the turning area does not count as a front yard and the required 3m garage distance to the street/turning area will be accepted despite missing 1.5m because the vehicles do not/must not drive all the way to the edge of the street when turning anyway. A space of over 2m width will be created there that simply remains unused. So cars have enough room to turn (6m radius).

And therefore I will probably get by with 1.5m distance from the garage front to the turning area.

He verbally confirmed that this is not a problem. I should just submit an application for a special permit? for the double garage along with the planning.

The application for exemption from approval relates to the house. And regarding this, he told me that if we hear nothing within 4 weeks after application, we can start.

However, I will still have a conversation with the gentlemen to see if there is anything against my plan with 4 residential units, since I was more or less unsettled here, especially by ypg

If your architect sees it the same way and knows the people at the building authority, it will probably work out.

Well, the parking space issue is necessarily linked to the house, is regulated in the development plan, and must be addressed in the construction documents. But if the building authority is that relaxed about it, you’re just lucky.
It would be nice to read about the further progress.
