Introduction Energy Ordinance 2014 - Evaluation Period

One of her questions made me think a lot: How do the authorities handle it if the building application is submitted this year, but the construction itself only starts in 5 years (provided there is no deadline for completion set in the development plan)?

My knowledge: Building applications are valid for one year – then construction must begin. After that, an extension (deadline extension) of the building application must be requested. In this process, the construction project can be rejected due to changed parameters.

we are planning to build in 2014. Currently searching for land and then planning the building application for the first half of 2014. So far, we assume the [Energieeinsparverordnung 2014] will come into effect earliest in mid-14. And we rather expect a tightening of the new building standard only in 2016.
Are we wrong about that?

Then your understanding is incorrect!

For about 2 years now, a building permit is issued for 3 years. After that, a new building application must be submitted - no deadline extension - according to the then valid Energy Saving Ordinance. A deadline extension is only possible - possibly - if the mandatory parameters have not changed.

As it currently stands, the new Energy Saving Ordinance will apply at the latest from 01.01.2014.

I am a bit confused now. Because the tightening has not yet been decided, but is apparently still with the committees. So it is quite possible that the tightening for new construction will only come in one stage, maybe in 2015 or 2016 - as requested by the Ausschuss für Städtebau, Wohnungswesen und Raumordnung.
The regulation, if one is ever decided, is supposed to come into effect "on the sixth day of the month following the announcement in the Gesetzblatt".
So a lot will certainly still happen before the amendment will have an impact on construction projects.
