It was included with us despite own performance. It was simply agreed that if there is a delay in own performance, the completion date will be postponed accordingly. If something is in the contract, of course something can be done. If not, then it becomes difficult. I think then only something is possible if one really has to wait an unreasonably long time.

The window color outside was gray and inside wood, and now it was delivered the other way around. (We were informed about this today, November 17, 20, and the installation appointment would be next Wednesday -> they haven’t just had the windows lying around on the site since today -> shouldn’t that have been noticed earlier)

The fact that we removed the floor slab from the contract was done in consultation with the developer, I have an email that clearly states if we finish the floor slab by the end of September, the house will still come in 2020. (The floor slab from the developer wouldn’t have come until January, and that’s why we changed it)

Just from the sentence alone, the claim for any kind of compensation is already dead. Apart from that, for what reason do you want to claim compensation? Have you now suffered any damage? ...the possible delayed move-in cannot be the reason, because you did not have a penalty for delay included in the contract. Everything that is not contractually regulated does not have to be provided.

Of course we are incurring damages, we now have to cover the foundation slab over the winter, have to have the construction power/water removed again or pay for it over the next few months. Furthermore, it cost us 5000 euros more to build the foundation slab on our own, and now it looks like the house will come next year (then the developer could have just built the foundation slab themselves). We have to pay rent for additional months even though according to the financing plan we should have been in the house since November. Furthermore, we are missing out on 10000 euros from the KFW subsidy....
