Hello,
here’s the situation: We have this paved, slightly sloping storage area behind the garage on the property. I would like to level it horizontally and build a long, as large as possible shed on the last part, basically as an outsourced hobby cellar. Preferably a cost-effective wooden construction.
Problem: This would be edge development. Behind the hedge in the picture is a narrow footpath (yellow on the map), which belongs to the city. Behind it, the trees stand on the next property.
The lady currently covering for the building authority during a vacation has already determined that, due to this "kink" in the property boundary parallel to the footpath, this side can be considered its own property side. Therefore, the shed can at least use the full nine (permission-exempt? permit-required?) meters of length and the length of the garage will not be "deducted."
But because of the "building encumbrances," she said I would presumably have to maintain the three-meter distance required in NRW. Luckily, on the side facing the footpath, only up to its midpoint — on the backside, probably three meters distance to the neighboring property.
Now I have tried to indicate the very steep slope of this entire quarter on the map with the purple arrows:
On the other side of the footpath, a slope descends into a gorge where a sewage canal runs. The trees already stand about five meters lower than the footpath. The topmost house E on E-street is ten to fifteen meters lower than the townhouses on the left on M-street.
And the neighboring property S1 is unused on the lower half where I want to build my shed in front. They let trees and everything grow wild there.
Of course, I want to waste as little space as possible there. What opportunities do you see?
The person at the building authority who makes the final decision will be back from vacation the week after next; until then I just wanted to get somewhat more informed (currently I’m still very clueless about building law, as you have probably already guessed).
