Garage too deep due to local design regulations

Regarding the initial situation:
Our architect has spoken with the building authority. The decorative gable does not count regarding the garage height. That’s already good. She also sent the building authority the current garage as it is planned. According to the building authority, it will be approved like this – however, without knowing the surrounding height information.
As can be seen in my sketch a few posts earlier, the neighboring property is at 69.39m and the architect has set the height of our garage at 69.48m. The 68.48m is located just next to the garage or even still within the construction area of the garage. Unfortunately, I cannot see this exactly on the plan, only estimate.
Ultimately, it now seems to be about 10 cm, at least that is my understanding :/
It must not be deeper than 69.48m, otherwise the garage will not work.

Can we ask the surveyor to shift the same height a few centimeters into the construction field of the garage, or is that already criminal?
To the eye, everything looks quite level there anyway. That way he would save himself the re-survey and I about 1000 EUR ;(

Incitement to forgery, yes. But I don't understand your problem: You are not supposed to exceed a total height of 3 m with your garage. You have already clarified that the gable facade is not included. The reference point for the height is unclear; in the worst case, with a 9 cm height difference to the neighbor, your garage would have to adhere to a total height of 2.91 m. That's actually plenty sufficient, or do you want to fit a motorhome in there?
