Height of the carport extension in setback areas

Hello dear sufferers,

as the title already says, I wanted to first ask here what applies in my case ;)

Following situation: Best see the sketch.
Between the house and the boundary, about 6m, a storage room 5m wide should be built at the same depth as the house (1m distance to the neighbor). In front, a carport of 6x6 (1m distance to the neighbor) should be attached.
All this should be built in timber frame construction with a 7% slope and surrounding parapet.
Due to the elevation, the floor slab had to be 60cm above ground.

Now to the question:

If the upper edge of the roof may be at most 3m high, I would later have a room height of about 177cm. A bit unsatisfactory. Before I drive the neighbor and the building authority crazy, could one deviate from the maximum height? 60cm would be enough with a room height of 237cm.

Also in Lower Saxony it applies that within the 3-meter boundary nothing may be higher than 3 meters. But that means the roof at a distance of 6 meters, for example, may start at 3.50 meters and then only be 3 meters high at the 3-meter boundary.

The sketched lower roofline is therefore already correct. You would have to design the slope differently to have more headroom on the left.

The question is only whether you need a building permit for the carport in Saxony-Anhalt.

Hello,

so the brown horizontal beam with a slope is my desired height and has an average room height of 2.50m and with the roof structure 3.60m exactly 3m distance to the boundary. The dashed horizontal beam corresponds to the permitted total height of 3m but then there is only a room height of 1.77m left at the end. The storage room with carport has a total depth of approx. 15m parallel to the boundary (1m distance). This was also submitted and approved immediately in the building application with the neighbor's signature. The subsequent increase was only determined before the groundworks, on-site appointment. The question is whether it is possible to deviate minimally with the approval of the building authority and neighbors or whether that is impossible in advance?

60cm is not a minimal deviation.

The case cannot be assessed without further plans and elevations of the property. It is best to consult an architect (you need one anyway for the extension) and a surveyor on site.

More plans? The elevations are already given, or do you think one can still find a higher point on the property? Is a deviation from the 3m height even possible if all parties agree?

What you have delivered is a section. If you want me to say something about it, I need site plans and I would need to know where the terrain elevations come from. Even then, it wouldn't get much further, so ask your architect/authorized building submitter that question.

You need them anyway and that falls within their professional and task area.
