First alleged fixed price and now additional costs - legal?

Well, you won't get by with 30k more either. Problem 1) what is not written was never discussed Problem 2) the construction service description includes everything that is included in the fixed price. Everything marked as [Bauseits] or completely missing is not included. You have to inform yourself about that beforehand. Check here in the financing section what other costs may arise Then consider whether additional financing is possible or to terminate the contract as the lawyer suggested. If you continue building, have the construction service description reviewed and involve an external expert. So far, you have been a bit naive and have already had to pay a lot of tuition fees even before the start of construction.

Yes, now apart from everything else: you can't get a house in Germany for 200k. We don't know the basic details (size, equipment, etc.), but 200 is simply never enough.

Just go to the Town & Country page, then look for the houses with the license plate of the area where you want to build, and there are quite a few that are well below 200k….

Our house only cost "290k". Our total construction costs are currently just under 700k.. and the outdoor facilities are still to come. It always depends on how you calculate "house"..;)

The question is, what one defines as a house. A few walls and a roof can also be a house to someone... it's just only limitedly livable. What apokolok surely meant to say, however, is that you won't get a ready-to-move-in finished house including outdoor facilities, furnishings, and additional costs for that price.

you are quite a clever guy. No, it does not. For the OP it is relevant that any maximum depths for BP or similar are specified. However, the contractor cannot claim additional costs solely due to the conditions on site if he did not inspect it beforehand.
