@te as far as I know, a pool is not allowed on the property boundary, of course it also depends on the federal state. And a built-in or buried one even requires a building permit.

The whole thing takes place in Hesse.

In my opinion, as a rule, no pool may be built in the setback area in Hesse. The Hessian Building Code (HBO) requires a minimum distance from the neighbor's boundary for swimming pools that are considered structures. This distance is usually 3 meters, unless the development plan or other regulations provide specific rules.

So definitely obtain an immediate stop of construction. In my opinion, the hole should be filled in layers and properly compacted immediately.
