Does the builder have to hand over the soil report?

Hello,

we bought a house with a developer in a larger new development area. We wanted to have the soil report because the water seeps very poorly on the lawn. so that we know how the soil layers are composed

The developer does not want to release the soil report. Does he have something to hide that he wants to keep secret there?

My question is whether the developer is obligated to release the soil report upon request?

Did the developer have to make a report for each plot of land or was one for the entire development area sufficient?

A developer house is bought "as seen," but you can also have the soil under the garden examined yourself.


As far as I know, he is not obligated to hand it over, and not even necessarily required to have one made if he trusts the building ground. Sometimes developers are satisfied with "spot checks" at intervals of three to four subsequent plots. We do not know your development area, but money is made in purchasing, and accordingly, lower-quality plots are popular with developers. These can include ones with problematic prior use, such as where contaminated sites are "sealed," which of course also affects drainage. The product is meant to be a neat bargain in the brochure. Very few buyers look through the local newspaper archives to see if their development was a long-forgotten eyesore. The zoning plan and its justification can provide clues. There is no obligation for the seller to disclose information like accident damage on a used car here.

Reasons why the water infiltrates poorly can be many. Most common is soil compaction caused by the construction machinery used. Absolutely nothing unusual if the soil is not sufficiently loosened afterward.

The land was previously used for agriculture, something was planted there before.

We loosened the topsoil about 20-24 cm deep with a motor tiller and compacted it again with a lawn roller before sowing the lawn.

Now the lawn is about 10-12 weeks old and the water infiltrates very, very slowly during rain, and puddles form immediately that only infiltrate after a few days.

What can be done about this now?

What kind of subsoil do you have? And does it occur everywhere, or only in certain places?

For example, I have a corner where a) during heavy rain, water flows down the driveway and collects there, and b) the "infiltrated" water also flows under the driveway to this spot because the clay soil drains significantly worse than the gravel. To make matters worse, there used to be a crane pad there.

The only help is deep loosening. My plan is to sow the strip with lupines in the fall, hoping that their taproot will break up the subsoil.

That sounds like our old plot in Lower Saxony. It was previously a cow pasture. Very peaty, firm soil. We also loosened it with a hoe before sowing the lawn, and both before and after the water drainage was poor. But not only for us, also for the neighbors. We chalked it up as "that's just how it is."
