Development Plan Bavaria: Permissible Roof Shapes Terrace Roofing

Hello everyone,

regarding the topic of roof shapes, the following regulation is included in the development plan:

Design of the roofs on main buildings
For main buildings, only gable, hip, and pointed roofs are permitted.
For garages and ancillary buildings, shed roofs with a maximum roof pitch of 15° and flat roofs are also permitted.

Does this mean, conversely, that it is not permitted if we plan such a terrace roof?

A terrace roof is not an outbuilding. So you can do it however you like.

How large is it?

Terrace roofs may be built or modified in Bavaria without a building permit procedure if their area is not larger than 30 m2 and their depth does not exceed 3 m. The construction of larger roofs, on the other hand, generally requires a building permit.

We are actually beyond that. Our architect said that based on the description in the development plan, such a roofing is not permitted and he would recommend not including it in the building application because it would then be rejected. We are aiming for a simplified procedure and would have liked to have this considered from the beginning to avoid further effort later. In my circle of acquaintances, I have often heard that roofing over 30 sqm is simply built without obtaining a permit.

If the architect has concerns, I can only recommend taking them seriously. Otherwise, delays will be at your expense.

If the architect marks a deviation from the development plan, it is no longer a simplified procedure.

I would advise against simply building bigger.

It is only about the "roof shape" of the terrace where the concerns lie. So, a terrace roof covering over 30 sqm cannot be approved using a simplified procedure?
