That is correct. The newly to be created dead-end should then already include the channel and all lines for potentially the entire area. Digging up afterwards makes little sense.

Regarding the question of what should happen with the farm: no decision has been made yet. In the long term, it will probably be demolished and the property then divided into several plots and also sold.

The matter of commercial use is not clear to me. Developing and selling a property that has long been in one's own portfolio?!

In my assessment, the meadow would be divided into a total of four plots of land, one of which we would develop ourselves. According to the statement, this means we would not be trading commercially.

What I don't quite understand is the statement from the city that the access road to be created will later be added to the public road network. It is part of the property to be divided. If the municipality does not acquire this part, it remains a private road. And building 55 meters of road doesn't cost a fortune. I think it should be feasible with 30K euros. Gas, water, sewage, etc. are extra. You would have to coordinate with the utility providers for that. Assuming good planning, I would handle the development myself and sell the plots at a good price.

"Acquired" is the keyword here.



The seller of our property was exactly afraid of this clause, so I did some research. Only if you buy something and then sell it again is it trading that can eventually be classified as commercial.
If you inherited the property, for example, you can divide it into X parts and sell it without it being commercial. Even if you still have it developed, it was the same case with our seller.

we ourselves, of course, want the street (area) to be as small as possible and as large as necessary. Ultimately, every additional square meter of road is building land for us that can no longer be sold. Perhaps it also makes sense to transfer the road to the city (keyword: traffic safety obligation)?!

Yes, the tendency is also to bear the entire development cost ourselves, divide the plots, and then sell them. I simply lack the experience to build there myself and then sell.

In my opinion, that is not entirely correct. I think it also depends on when the property was purchased – before the inheritance. Maybe our tax advisor can comment on the subject?
