Claims for damages against the city have already been suggested by our lawyer (without an amount).

Newspaper, well, our rubbish paper ...

All parties involved are frustrated because facts are being created here that will probably remain as they are.
Unbelievable also that the builders laugh in our faces and say "your stupid German laws don’t interest us" ... and apparently even get their way, which we consider the real scandal.
(we are not xenophobic!, this is about the matter)

If even half of that is true, then let your lawyer (specialist lawyer for construction law!?) get to work!

You can kill the project financially very quickly: the currently planned footprint is known, as is the rent index, the net return should be max. 4%. Double this value and present it as an annual payment so that the building can be occupied/operated as it is currently executed. Additionally, make sure you get a proper one-time payment guaranteed - which basically means that the investor builds, deals with the tenants, and you as neighbors annually withdraw the entire return plus a premium.

You can only get him with money; little can be achieved by reason.

On the other hand, he has already advanced his construction so far that he can hardly turn back. That can be exploited coldly; I wouldn’t have any scruples about that either.

Hello Mr. Grafe, officially we are located in a new development area for single-family houses / semi-detached houses, which may have a maximum of one granny flat. The whole is operated by a family (private individuals) who clearly indicate that they will rent out parts of the created residential units. On what grounds could we initiate the above-mentioned invoice?

Oh yes ... the builders have received it in writing, however - and we got the information through the lawyer's insight - that the construction is not justifiable under urban law in this way.

That should actually be explained to you by your lawyer. If the BV is 4m too high and easements are needed on your properties, then one can demand whatever one wants for the easement registration. I would set my price just high enough to spoil the investor's fun with his project - that's when you get into negotiations at the latest.
