Possible. Such things usually only become apparent when a new building application is submitted. Then the existing condition simply exists, whether (correctly) approved or not.

Yes. For the clearance area, the upper edge of the parapet railing applies, i.e., a 3m garage with a 1m parapet railing has a height of 4m and is then automatically no longer a privileged building. Clearance areas of a balcony are also calculated, for example, from the upper edge of the finished floor of the respective floor plus the height of the parapet. A balcony on the 2nd floor thus has a calculated height of, for example, 2 x 2.8m + 0.90m parapet = 6.5m height above ground level. The depth of the associated clearance area is then calculated accordingly.
