Completion date in General Contractor Agreement - Wording assistance

Hello everyone,

in our GÜ contract it will state that the readiness for occupancy will be 10 months after the start of construction and the completion date will be 12 months.

However, we want to phrase the paragraph so that readiness for occupancy must be in 2020 in any case, otherwise we will not receive the Baukindergeld. It is also problematic that the development work is still ongoing, but according to the site manager will be completed in September. That also needs to be somehow included in the paragraph.

Can someone here provide expert help?

The entire contract has already been reviewed by a lawyer - did not want to pay another €220/net per hour.

It depends more on the start rather than the completion. If construction begins and the building permit is granted by the end of 2020, the application can be submitted until the end of 2023, provided the funding is sufficient.

Unfortunately, that's not the point - it's about our income, which was in the range in the years 17 + 18 that we qualify for child construction allowance. If we only move in in 2021, then the years 18 + 19 count - and then we earned too much.

Precisely because of the problem that no one knows how long, for example, the development will still take, the general contractor cannot provide this certainty. Imagine if a lawsuit against the residential area comes from somewhere or if a treasure is found during the excavation... then there will be a standstill for the time being, which your general contractor cannot be held responsible for. Or how should he then, if this worst case occurs, provide a ready-to-move-in house within a few weeks? But it could also be that your building authority takes a little longer for your application, and so on... In my opinion, general contractors cannot factor in this force majeure.

Have you planned any personal contributions? Flooring? Electrical work?
