I am surprised that this otherwise very virtuous forum does not raise the moral finger on similar topics here ;) We are hearing one side. There is also another: a young family has been applying for a building plot in their hometown for years and so far has always been unlucky, annoying but bearable. Now a kind of "investor" (yes, he is not a real one otherwise he would build and then sell for a profit) has several projects underway and thought "such a plot in the new development area Posemuckel would suit me well too" and has - apparently WITHOUT need - the luck that was denied to the family and got the contract. And to prevent exactly such people from blocking such a valuable building plot as a kind of toy, there is this construction obligation... I would find it great (sorry to the OP) if this seller now simply could not sell but has to pay this penalty and a family from the waiting list comes to unexpected happiness... just my opinion ;)

I actually have to give a like for that. We are indeed in this situation. In the development area, fellow citizens who already own property are building. They can continue to apply, acquire plots, build on them, and enrich themselves. We, on the other hand, do not yet own any property, are in our late 20s, and have had no opportunity to build so far. In the end, I am trying to circumvent it just the same, only I can do it with a clear conscience.

Well, only... if the municipality has to give its approval and does not want such disposals, then it's not a "only". But good luck with the attempt.

Attention layman's opinion: You could establish a GbR with the seller (or for more security, a GmbH) with the purpose of constructing a single-family house on the said property. The partnership agreement will include that he provides the land and you pay for the construction and are allowed to act as the client towards the executing companies, as well as that upon completion the property together with the house will be sold to you against a difference amount XY.

I don’t understand the whole thing – maybe my rationality is getting in the way: 1. "The seller has several construction projects" that does not sound like having difficulties, also acting as a developer for your house; 2. "even a selling price twice as high would still be ... attractive" then the seller could go significantly above cost price; 3. "he would sell at cost price" if I compare his “loss” from unrealized purchase price potential if he only sells at cost price with the loss of getting his original purchase price back without interest and reduced by three euros per sqm (see contract in post #14), then combined with his "several construction projects" the overall picture arises for me that he is down to his last breath (because otherwise – i.e. if he couldn’t calculate – he wouldn’t have gotten into several construction projects). One should not get on board with someone who is standing at the brink ;-)
