Can a construction manager resign due to poor performance?

Hello everyone,

thank you very much for the feedback. The contract with the construction manager is such that he has already received a down payment. Upon completion, he will receive the rest. The contract with the construction company was designed so that we only have to move in.

He lied to us in the following points:

- missed the appointment because of traffic jam (was eating with his wife)
- forgot red dot in the car (upon inquiry at the office, the application had not yet been submitted)

He does not fulfill his duties:

- submitted applications for gas, water, electricity, and telecommunications too late, causing the date to be further postponed
- demands money from craftsmen whom we brought through contacts
- brings only one offer for necessary work = no possibility of comparison
- meeting protocols are completely missing
- he bought a water tank that is too large and an additional panel for the roof without our consent
- offer from the roofer, who has been trying to roof the house for 4!! months (incompetent and unreliable), is faulty and incomplete

The following points still need to be done on the house:

Roof completion
Roof insulation
Screed
Tiles
Gas, water, electricity, telecommunications connections
Lowering the ceiling
Stair railing
Laying tiles etc.
External insulation, plaster

That sounds so adventurous, where should one start? What does the insolvency administrator say?

Off to the (specialist) lawyer!

We have submitted our claims in an application to the insolvency administrator. So far, unfortunately, without any feedback.

The danger is IMHO rather that the insolvency administrator has claims.

But the new site manager has nothing to do with the insolvent company, right?

I would also go to a lawyer.
You are really unlucky.

No, the site manager has nothing to do with this company.

Is there a possibility to put the site manager in default? What claims should the insolvency administrator have? Which specialist lawyer should we consult? Construction law? Contract law?
