Specialist lawyer for construction law. Insolvency does not automatically lead to the termination of the contract for work. If applicable, there is a claim for performance and, of course, payment of the existing contract. Continuing to build "just like that" in the event of insolvency can be a mistake. One can start by googling a bit, but in my opinion, it would be better to immediately consult a specialist lawyer for construction law as soon as the insolvency becomes known (first signs). Now the rule is: better late than never.

Regarding the site manager: No idea... Why should he have a "red dot" on his car if the shell construction has already been erected? I can't make sense of your descriptions. However, I don't think we should unravel this further here or that it would be productive (I have too little knowledge for that, and in my opinion, you do not provide the necessary information thoroughly enough). Get advice based on the contracts that were actually concluded!

Hello everyone,

the situation has finally gotten out of hand. Today, craftsmen showed up at the house wanting to do the exterior insulation. This order was never approved by me at any time. I then expressed my disappointment and surprise to the site manager without raising my voice or being offensive. I told him that we need to talk about whether it might be better if we go our separate ways. His response was, "If you see it that way, then we will do that."

After that, I received the following message.

Dear Mr. ...,

as discussed with you by phone, we are terminating the site management for extraordinary reasons. You will receive the corresponding termination by mail in the next few days.

Does the site manager still have claims to his fee after the extraordinary termination, or should we send an extraordinary termination by registered mail tomorrow as well?

You should visit a specialist lawyer for construction law as soon as possible, that is, ON MONDAY, with all the documents, contracts, and whatever else you have at hand.

One danger is not yet averted, and you are opening the next money pit.

No one here can help you. Any recommendation would be negligent due to lack of complete knowledge, and legal advice may only be given by those who are qualified, respectively lawyers.

Any advice here about what to do clearly constitutes legal advice, and the person is liable for their answers.

Why don’t you actually listen to the writers here? Instead, you keep asking new questions.

I currently see claims coming at you from the insolvent company as well as claims from the site manager. But only a lawyer can assess that.

And in the end, you pay four times for one matter. That only earns a shake of the head from me.

I doubt that, but I agree with you on all other points.

In this situation, no discussion in the forum helps; as an expert, I strongly advise you to consult a specialist lawyer. Even if it hurts, you should invest the money. Experts and lawyers are usually only consulted when it is too late. When buying a house, it involves a lot of money, so you should think about what you prefer: damage limitation or following the advice of laypeople. Playing with risk is definitely wrong. Good luck and don't let yourself be brought down.
