Thanks for such a detailed answer. I don’t have the development plan at hand but yes, because of noise protection a window orientation in a certain compass direction is prescribed. The drafter ignored this for one window and offered compensatory measures in the form of extra soundproofing which was not accepted by the building authority. And unfortunately this slipped past us because in the haste we didn’t check all her corrections again.

Extra fees are okay, but much more important now is the question of how to proceed. Yes, waiting even longer is bad. We are already in a difficult situation regarding time. So for me it is now important to decide whether to withdraw this application now and submit a new one, even if that means fees, or to just swallow the situation?

We unfortunately no longer have a fixed price, so the later we start, the more expensive it will become, I assume...

How come? If the developer delays the start of construction due to their fault, shouldn't that be their responsibility?

So without knowing all the details of the agreements and the draft - it is quite common in building applications to test boundaries regarding deviations if it benefits the construction. The window will have a function in that location. I wouldn’t consider that a culpable complete failure, I’ve seen bigger blunders in my work... Did you make it clear to the developer that there must be absolutely no delays and that this was documented in writing?

It’s not about the developer’s fault (unfortunately). According to the contract, we had to obtain the building permit within 6 months to maintain the fixed price until completion. We didn’t manage that because we also experienced some delays with the development of the plots and personally due to the birth of a child. All in all, admittedly, we also signed the contract with the BU too early (end of November)... It couldn’t have been done any other way, since my wife was about to start parental leave and I was about to change jobs. Otherwise, the financing would have failed. It is admittedly unfortunate, but we hardly had any other option. Either we would have lost the plot or we would first have had to buy the plot variably and only later deal with financing the house construction. Even in that case, building the house would not have been cheaper than the current situation, but eventually more difficult/more complex with the financing. So we have to swallow the bitter pill of the price increase anyway, regardless of the delayed building permit.

Yes, we have first summarized it in writing from our perspective and are waiting for the consultation meeting next week.
