That depends on the subtle but significant differences between the federal states. Sometimes the procedures even have the same names but completely different conditions. The simplified procedure in Brandenburg has very little to do with the earlier simplified procedure in NRW.
Speaking of smart-aleck remarks: You mean the approval exemption according to §63 Building Code NRW 2018 (or §67 old version) and not the simplified approval procedure according to §68 old version.
In the simplified procedure, the authority can also take 3 months §63, para. 4: (4) The building application shall be decided upon within three months after submission of the complete application documents; the building supervisory authority may extend this period by up to two months for important reasons vis-à-vis the builder. The application is deemed to be approved if no decision has been made within the period specified in sentence 1.
Thanks for such a detailed answer. I don’t have the development plan at hand but yes, because of noise protection a window orientation in a certain compass direction is prescribed. The drafter ignored this for one window and offered compensatory measures in the form of extra soundproofing which was not accepted by the building authority. And unfortunately this slipped past us because in the haste we didn’t check all her corrections again.
Extra fees are okay, but much more important now is the question of how to proceed. Yes, waiting even longer is bad. We are already in a difficult situation regarding time. So for me it is now important to decide whether to withdraw this application now and submit a new one, even if that means fees, or to just swallow the situation?
We unfortunately no longer have a fixed price, so the later we start, the more expensive it will become, I assume...
