Building notification who has experience with it

Hello everyone,

about 1.5 months ago we submitted our application for a building permit through a simplified procedure (because it is a new housing development). Unfortunately, our architect did an extremely poor job and we received a request from the building authority to correct numerous errors. After back and forth with the architect, we are out of the simplified procedure and now it turns out that we also need a special permit from the municipality because a window is positioned in the wrong direction and is not compliant with the development plan. This could have been avoided by moving the window to another wall. We received 0.0 advice from the architect regarding this. This special permit will now take another 2 months.

Now, an employee of the building authority pointed us to the option of a building notification. He said everything must be 100% correct for it to be approved and for us to start building after 4 weeks. Given how sloppy our architect worked, we don’t even trust her to prepare a building notification. The additional delay of 2 months is also a catastrophic situation for us. We request a meeting with the construction company and want to insist that they cover the costs for the building notification if we finally decide to go this route.

Does anyone have experience with building notifications or advice on how to best handle this situation?

Maybe I'm missing something, but the "Bauanzeige" is exactly the "simplified procedure" you mentioned at the beginning. I assume that once the errors are corrected, you can submit another Bauanzeige with the correct plans, and that should then be approved. Could you perhaps ask the construction company for a more competent architect to take over the whole thing? In case of doubt, also educate yourselves again about what is stated in the development plan and try to check the plans yourselves as best as you can. For example, the window orientation could have been seen by yourselves.

No, these are two different procedures. As for self-checking – I of course agree with you on that.

For the building notification, a plan is required that complies 100% with the specifications of the [B-Plan]. That is not the case with you, is it? Or are you planning to revise so that you have no deviations anymore (keyword windows). In the end, it is your risk that possibly a construction stop or worse things may come upon you if the planning was not done correctly.

Are you sure about that? I just reviewed our documents again, we have a development plan and are in Lower Saxony, our construction company planned in accordance with the development plan and after the building notification we received the "go" to start construction within 2 weeks. I vaguely remember that "simplified procedure" was mentioned somewhere, which is why I thought it was the same. But I'm not sure.

Yes, exactly, that is our current thought – to move the window to another wall. That way, point 6.3 will be complied with. We have clarified that with the building authority. We have already adjusted all the other points; those were really just minor errors. The whole thing is all the more frustrating since there are really no major deviations.
