Buildable according to §34 - what does it really mean?

Where does it say that we would take it at face value if they tell me on the phone "City villa not allowed"? I merely wrote what kind of reply I expect - nothing about my reaction.

Hello Thomas,

our house was also planned and built in an area without a development plan, i.e. according to §34.

Therefore, we first looked at the houses on the street regarding:

- Ridge direction
- Distance from the street
- Eaves and ridge height
- Dormers
- Roof pitch
- Knee wall height

Then we thought about how we roughly wanted to design our house and went with these ideas fixed in writing to the head of our building authority to ask what was possible and what was not.

This conversation was worth its weight in gold, as the gentleman from the building authority gave us many very valuable tips regarding the possible placement of garages, knee wall height, and terrace construction.

Also, in the subsequent building permit procedure, he adhered 100% to what he had promised us in advance. Our building application was even approved directly without involving the building committee of the municipal council – the construction project was merely announced for information at the next city council meeting.

Therefore, I can only recommend you proceed in the same way initially.

If something then seems strange to you, the option of a preliminary building enquiry is still available to you – but, to my knowledge, this costs additional fees.

Called the building authority today first to get some initial information before we go there directly. Asked how exactly §34 is to be understood, since much of it is a matter of interpretation. The lady was quite "friendly" and said: "You have to figure that out yourself. Go to an architect."
A promising start...
