There are 110m² of floor space (ground floor) in the house. A second full storey is not permitted according to the development plan.
The 1st upper floor may (see architect's calculation) have 74.99% of the floor space, so that it _does not_ count as a full storey. The calculation shows that the house has 110m² on the ground floor and 81.2m² on the 1st upper floor, slightly less than the permitted 82.39m², therefore the 1st upper floor could still be 1.2m² larger or alternatively an additional 1.2m² of living space could be created in the attic (if legally possible at all).
In my view this is maxed out, since according to the building regulations all living space above the full storey (ground floor) may only have a maximum of 82.39m². Theoretically, this can also be built as 2 upper floors, but the total area of 82.39m² must not be exceeded.
