That has nothing to do with it and does not include any flex right concerning the gate leaf fixation.

The question is what the law allows: with a right of way as a pedestrian right, there will be no objection against only half of a 3.5 m gate width; with a driving right, however, a clear passage width must also be ensured.

Do the tenants have a Smart or Twizzy, or are they street parkers?

You have a registered right of way in the land register. That basically says it all.

What does that mean? That a 40-ton truck is allowed to turn there, or that a 7.5-ton truck is allowed to drive through?

If it is a right of way, it does not even entitle one to roar through the little gate with the moped.

3.5m is completely sufficient for normal things. However, the large devices won't get through there now. Legally it gets difficult, a friendly agreement would be simpler. Otherwise, you probably have to drive around the thing.

Strictly speaking, one would have to consider not only the registered right of way but also the basis of the registration. In our case, this specifies much more precisely than can be seen in the land register which width the right of passage includes and at what distance from the cable installation strip the neighbor is not allowed to plant anything, etc.
