5-year warranty expires, toilets installed too high

Hello,

in September 2019 we will have been in the new house for 5 years and are now in the process of collecting possible defects.

What we have noticed is that the toilets in the house (3 pieces) were all installed at a height of 45 cm (ceramic top edge). Or rather, the connections only allow for such an installation.
The neighbor (same construction project) had requested this installation height as a special wish, but it seems it was initially not implemented for him but rather mistakenly for us. We could never really get used to the toilet height!

Am I correct in assuming that this is a defect? What would a correction cost (wall-hung toilet, concealed cisterns, tile panel centered with 60x60 cm tiles)? Can we insist on a repair or possibly on financial compensation if we no longer want to deal with the mess?

Have you already complained about this immediately after moving in? Otherwise ... in my opinion, this is not a defect to be raised shortly before the end of the 5 years.

By the way, I find 45 cm quite normal. My chairs, for example, also have a seat height of 46 to 48 cm.

I assume you recorded the "defect" as a defect in writing in the acceptance protocol! So why wasn't the defect fixed within the 5 years?

Or are you now trying to grab some money after 5 years? I assume you don't even know how to threaten with a lawyer because it apparently didn't bother you for 5 years. After 5 years, it's no longer a defect; you don't have to be a lawyer for that. Common sense is enough.

Where is the defect now? You had a functioning bathroom built, accepted it as is during the house handover, and lived in it for almost five years. Therefore, no defect.

Or do you now want to criticize the beech-colored doors, which you no longer like today and which would actually be much nicer in white? Or or or...

Take it positively, we have a top edge of 52 cm, during the sample selection that was our optimal sitting height my wife and I are both over 180 cm.

My grandparents are happy every time they are with us that they can get up from the toilet without any problems
