With good arguments, an exemption according to §31 of the Building Code is possible. But if the building authority has already sent negative signals, it will be difficult.

Why not, actually? Apparently no neighbor has adhered to the ban on dormer windows, so the attic can quite easily become a full floor.

No, unfortunately not. The circle around the Roman numeral 3 means "mandatory." A planning law expert might perhaps argue that the drawing was created before the Planning Symbol Ordinance came into force and that the circle does not appear in the legend of the development plan. But that's a thin argument...

The property is intended for multi-family residential buildings, which the neighborhood has mostly also implemented. I recommend selling and looking for a suitable property. Especially since the number of floors is not the only problem – I’m just saying trees and building lines.

It doesn't seem to me that there is a lack of space for parking spaces - therefore I see potential for the deal that a property developer builds a multi-family house for you, gives you your "bungalow" from the fully developed plot, and markets the four-family house built on it (or that you negotiate the same with your house bank). My proposal naturally also works if you want the penthouse instead. So I do not see a plot with more building volume potential than you need yourself as a disadvantage.

What about a two-generation house, for example, with a penthouse apartment on top that extends like a bar over a two-story building? Or an office rental in the full attic floor, then it’s quieter in the evening. Maybe a semi-detached house would also be an option? With a parent level or office level on top with a roof terrace? Some build their three floors with a basement, you could (what a sin) move your "basement" into the attic... I would collect such ideas and weigh them when considering selling the plot. In my opinion, it depends on how you assess the location of the plot and whether there are any free plots for single-family houses in your area that would be suitable.

It says there: Building bases must not extend above the finished floor level of the ground floor and may not be higher than 30cm. What exactly does that mean?


Does that mean I could possibly manage to build 2 full stories and then specify the attic as the third story?


So it should stay under 13 meters?


How can you tell that the neighbors have not adhered to that?



Selling is not an option since it has been in the family for ages. There are two trees where the building is to be erected. I would then have to apply to remove them... How do you know there are trees there?

Thanks already for the ideas. How can I imagine a penthouse apartment if the roof has to be a gable roof? Sorry, I really have no clue in this field yet.

One last question. How many stories does the house in the attached picture have? Just so I can get an understanding.

No. Looks like 3, I would say. In the attic, presumably more than 2/3 are higher than 2.30m in relation to the floor below.
