What is allowed to be built? Alternative to the building permit application?

Hello everyone,

how can I find out in advance what type of house I am allowed to build on a plot that lies outside a legally binding development plan?

Plot: 400m²

The call to the responsible building authority brought me very little because the lady was unfortunately very brusque and said I should submit a building preliminary request, which I should prepare with an architect. She did not even want to tell me the dimensions of the plot.

I do not want to invest a lot of money in an application because it is not certain whether we will get the plot at all.

Maybe you have some tips for me on how it can be done more easily?

I can understand the lady. Does the seller have no other information on the size? Don’t you have an excerpt from the land register?

Is it located within a continuously built-up district? Then it must conform to the immediate surroundings according to §34 of the Building Code. What that means cannot be clarified over the phone. However, many municipalities offer free, though non-binding, building consultations. There one could roughly outline what is feasible.

Is it too much to ask to measure it yourself using TIM-online? For a purchase decision, it does not have to be exact to the square meter.

Building authorities have consultation hours. I would go there. Who is selling the property? Some information should already be noted in the [Exposé]. How far away is the nearest house?

Note, according to the insertion requirement under section 34, it is not the nearby and wider surroundings that count, but really the immediate neighboring buildings on the same side of the street. For example, to your left stands a three-story building. Next to it is a gas station, then a single-family house with an attached flat roof extension, where there is a snack bar. On the other side is a two-story building with a gable roof, red, then an inn, three stories, with a parking lot, then a semi-detached house, white plastered, anthracite roof. You notice now, commercial use is allowed there, you are allowed up to three stories, you are allowed red and anthracite roofs. That’s roughly how it works. Here there is currently a dispute under section 34, in the middle of the center of a farming village an investor is building a three-story house with 12 residential units. There are signatures, protests against it, because it is said to be incompatible, but the building permit cannot be refused, because right next to it there are barns with similar ridge height and mass, and because the municipal administration is also three stories a few meters away. So this apartment building must also be tolerated. Karsten
