On the subject of tax class choice and income tax The tax class, as many have also stated here, has no influence on the amount of income tax to be paid at the end of the year. Whether it is 3/5 or 4/4 or 5/3 is completely irrelevant. However, there may be differences in what remains at the end of the year. An example would be a wage garnishment calculated on the net salary. If the debtor has tax class 5, less is garnished than with tax class 3 or 4.

You have tax class 5, even if it does not apply.

Wrong. I do NOT have a tax class because I do NOT pay income tax :p

edit: I know what you mean... but I still insist on not having a tax class..

wrong. At some point you submitted an application that deviates from the 4/4 and you want the income tax classes 3/5 because you have no employment income. That is exactly where you commit yourself to income tax class 5. If you were to start working somewhere as an employee, you would automatically be in class 5 as well.

Well, yes and no :)
You just don't know your wage tax class explicitly, as it is irrelevant to you. But your wife can only have class 3 if you have class 5. Her registration also results in a registration for you.

If you want to know exactly, have your tax advisor make a query in ELStAM or request an excerpt of the stored data there according to BDSG. I believe you can also do this with the tax ID via ElsterOnline.

Exactly! Then I would automatically be in class 5. At the moment, I pay no income tax... ergo, I can't have any income tax class :p
