Survey task of the construction company?

Hello dear ones,

we have hired a construction company and have a fixed price guarantee for 12.5 months.
Now we are at the stage where we have submitted the plans to the district office for approval, and as it turns out, they want additional documents.
I have the impression that my construction company is dragging their feet because they are not delivering the missing documents right away, etc.
The current problem is that the height measurements have not been done, and now I have to find a surveyor. Shouldn’t something like that have been done before submitting the documents? Moreover, is that even my responsibility? Unfortunately, the contract says nothing about this, but I assumed the construction company would handle something like this. Why is this coming up now?
Honestly, I have the impression that this is being done intentionally so that we cannot keep the fixed price.
Can anyone explain this or does anyone have a tip on what I should do in this case? I am currently also considering consulting a lawyer.
Would be grateful for feedback.

Hello Yasmin, if nothing about the surveyor is mentioned in your scope of services, then it is not included and the client has to organize and pay for it. What makes me suspicious here is that you have already submitted a building application. Who created it and based on which survey documents?

With us, surveying would also have had to be commissioned by the client side.

Did you have the construction service description (contract) checked or just signed it blindly?

What does it say, for example, about earthworks, site setup, construction power, construction water, etc.?
No offense, but if you have already overlooked the surveyor, now is definitely the time to read the contract very carefully again, otherwise the fixed price guarantee will surely be lost at some point because you thought something was included and the construction site is stuck.

Unfortunately, I can't say anything different either.

If nothing is stated in the construction service description, it is not included.
Then, I assume you have not had them checked, more items will come your way.

"Assuming" is not part of the contract's performance.
You can still have the contract reviewed afterwards. Costs a few hundred euros... then you will be sure regarding additional costs. The next big chunk "earthworks" is coming up!

Surveying has to be done, and everything that is not included as an inclusive service in the contract is probably always the responsibility of the client. So your task.

In our contract, this was also not included, but the construction company works with a surveyor. They commissioned him and we paid for it.

To protect your own interests, I would also act as quickly as possible.

However, one question is also bothering me, namely this one..



The documents for the building application must contain the exact position and height information.

As I understand it, the building application was submitted without position / height / ... and the office said "Half of it is missing! Please submit it later!"
