This is a persistent myth (which is indeed sometimes tried because some builders believe in it, notably those of the Fleischerhaus-GU type), that one could simply choose the timing of an insolvency filing.

In order to avoid claims that one does not want or cannot pay, bankruptcy is unfortunately also possible. Therefore, my recommendation is to demand a contract performance guarantee. In the event of financial difficulties, the bank will not provide this.

GU = General Contractor: company that executes a construction project with its own employees as well as subcontractors
GÜ = General Developer: company or person who carries out a construction project but does not maintain their own construction operation. The GÜ can commission both subcontractors and a GU for the construction work
Developer: GU or GÜ who sells you a house or an apartment including the land, which is newly built

This instrument is absolutely recommended. In rare special cases, which the public prosecutor does not like to talk about, yes. But not in the sense of the common notion that if someone does not feel like paying, they just quickly transfer the Ferrari to their girlfriend, then throw the office key at the district court and laugh at the bailiff from the penthouse rooftop terrace.
