Subdivision of land parcel resulting building regulations / costs

Good morning everyone,

I am new here in the forum and have been a silent reader for a few days. A few weeks ago, we were offered a plot of land from within the family, and from that moment on, things moved quite quickly, and we decided to build a house. Unfortunately, we have now encountered a "problem" that has been keeping me awake at night for a few days. The plot is to be remeasured. This means that one part is to be assigned to another parcel, which is already developed. I have tried to find information on the internet but have not found an exact answer.

Firstly, the costs are a question: according to the internet, new surveying can quickly cost several thousand euros. Are there any rough guidelines or formulas that can be used here? And what is even more important, what does it look like after a parcel subdivision? The building regulations and building boundaries will surely be reassessed, and you lose even more of the mentioned space, right?

I hope you understand my questions; the whole topic is completely new to me.

During a subdivision, exactly the opposite happens. A part of a property, which was previously created in the cadastral register by parcel division, is deregistered from the land register in order to then be registered on a separate land register page in the event of a sale. To be able to assess whether a reunification with another property will then be necessary again, you need to show us a (generous) excerpt from the cadastral map and provide some more information about the planning. 3000€ Fee regulations, depending on the federal state – BW is correct? No. That depends on what you mean by that. My spontaneous answer is "no." However, distance areas must also be observed from the new boundary, so the building possibilities may indeed be more restricted. Here, too, a site plan, information about the development plan, and the building project are missing.

Perhaps this was somewhat incorrectly expressed. The portion that is withdrawn is to be "added" to the other parcel.

I will send you plans: these concern parcels 222/3 and 219/2. Parcel 222/3 is developed and also belongs to the family. A part of 219/2 is to be transferred here.

Exactly these distance areas are already worrying me. Our building project envisions planning a two-generation house. One house with approx. 110 - 120 m2 over two floors. Additionally, an extension with approx. 75 m2. That was the first idea, we will also wait and see what the architects and developers offer us.

Here in BY the surveyor measures every point. The setting of new points is then added. You can inquire about that at the Regional Surveying Office. Send them the plan and how you want to divide. Then you will have binding figures. 3k seems a bit much to me.

First look for the existing survey points and possibly expose them.

But costs also arise again at the notary as well as with the utility providers.

Individual advice via private message is not subject to the critical control of the public and usually turns into work. For this, there is the professional group of publicly appointed surveyors (öffentlich bestellter Vermessungsingenieur). In anticipation of a lucrative contract, the initial consultation should be free of charge. Yes, in Bavaria there is no other option, since there is no publicly appointed surveyor there. In the other federal states, the offices have little interest in private contracts. This tip is probably only useful in Bavaria as well. For your information: ... designates a company that sells you a house to be built on a plot of land. What you mean is a general contractor (GU).
