Right to hand over documents related to the Energy Saving Ordinance before construction begins?

Good day,

We finished the soil replacement work today and next week the general contractor will begin with all other trades. We want to have all measurements and energy requirements checked by a building surveyor. For this, the [Energieeinsparverordnung] would be relevant. When asked, our developer stated that we would receive this after completion, because the contract says that all construction documents can be collected after the house is completed.

However, in this way we could never verify all requirements, for example which perimeter insulation is planned for the floor slab and whether this thickness will also be maintained. What can be done here?

If it really is a developer, you can't do anything, it is his house. When it is finished, he hands it over to you, just like when you buy an existing property.

You could at least, provided you are allowed to enter the property, check what is being installed and (photo)document it. Afterwards, compare IST <> SOLL.

Hello, thank you for the feedback. I may have used the wrong term. I meant that we signed a construction contract with a construction company (which I believe is called "Generalunternehmer" in this case), according to which they build a turnkey house for us. We have already purchased the land ourselves. So the construction company then builds the turnkey house on our land. Does that change anything?

Oh right, then you must have the plans as well, after all you have to sign them for approval.

The architect did that. According to the contract, she is responsible for all inspections and construction preparations. We had the building application at her office back then, which she had completed entirely, signed. We also have a copy of the building application here, but without these two documents. These are apparently no longer mandatory parts of the building application.
