Question about contractual completion

- When is the contract conclusion planned? How many months are there from contract conclusion until the end of September 2017? (More than 12? --> I would find that outrageous.)
- What type of contract is it (GU/GÜ or BT)? If BT, the soil condition should be the risk; the corresponding clause can be attempted to be deleted.
- Of course, a regulation beyond the end of September is missing (example: 50 euros per working day for completion after the end of September)
- I would write a concrete date; "end" is so flexible ...
- I would delete _one_ date and the 2-month clause (the date then fairly at the end of September).

Whether I would accept all this depends on my alternatives.

From the perspective of the builder, I can understand it. You have the winter of 2017 in between, so a lot can happen.

When building new, you should never calculate too tightly. That is the typical double burden and construction period interest.

Just ask the builder what can happen and what his usual completion times are. Our builder was finished about 2 months earlier. But it was also a mild winter back then. I also assume he means you no harm.

Developer (BT) = land and house from a single source
General contractor (GU) = land is available, the GU delivers part of the house

So, with what type of provider do you want to build?

Contract signing at the end of the month and construction start is only in autumn with completion in July 2017. So completion takes almost 18 months (but only 10 months of that is the construction itself). They are building almost 100 houses and we purchased one of the last.

It is a larger developer in our region. The alternatives here in Cologne are rather poor. The demand is gigantic. If you want to change half of the contract, it can well happen that they look for a more convenient buyer.

Ah, I see. I would try: - To have a concrete (!) date (e.g., 09/30/2017) contractually fixed. - To agree on a contractual penalty in euros/day from that date. I would probably accept the date itself. The payment schedule is based on the progress anyway. The only problem left is to make the financing suitable (commitment interest). If you have good creditworthiness and sufficient equity, you could simply finalize the financing later (risk!). Possibly, the BT also requires proof of financing at the time of signing.
