Relationship fails, who gets what?

Are you 100% sure about that, because when I was at the notary (there was a secretary we talked to) I was told that if you are a landowner you are the sole owner of the house on that land. :confused::confused::confused:

So for the future, all costs related to the house (electricity, garbage disposal, etc....) will only be issued to the landowner / house owner.

It’s different if the property is bought by both people together.
Then both would be house owners.

Under contract law, that’s how it is.
Whoever is the registered owner is always held liable. Obviously.
But there are also civil law claims for compensation.
That means your partner can kick you out, but you then have a claim to get back the money you invested.
In practice often difficult, because after years it often can’t be proven who paid what anymore.
That’s why I would draw up a contract that regulates that you both build a house on your partner’s land and in case the relationship fails your partner has to repay the money you invested. Of course, careful records should be kept of who paid what.
That’s how I see it, but I’m not a lawyer.

Basically, in Germany... As soon as a house/building is firmly anchored to the ground, it belongs to the property, that is, to the property owner.

However, it is not that simple, you should definitely consult a lawyer.

Hello,
so the situation is similar for us and after consulting with the tax advisor, we decided on a (in my opinion) relatively complicated arrangement: My parents gift me half of the property and "sell" the other half to my boyfriend. This money, in turn, goes to me and thus flows back into the financing.
Money would only be exchanged in the event of a separation, otherwise this agreement will exist on a (notarized) piece of paper, which will lie in a drawer.
Thus, the property belongs to both of us through the land register entry, but my parents and I are secured in case of a separation.
