None of that will help you. He won't do it, and your construction site will remain idle for years. Legally, you have no options to achieve anything promptly.

1) I would try to resolve it this way, without a lawyer or anything.
2) If he refuses; okay, then I would like to have it in writing for my records.

He basically says that he neglected it, if you can now prove that this is not correct, how is he supposed to talk his way out of it?

The question at the end of the day is that for many it will come down to a financial compensation or an extension of the warranty. But how high do you set that? Considering the possible damages that could occur....

If you knew that roughly, what is it, two days of work for one man?

One day to dig up and uncover. Wait overnight to see if the heating pipe is damaged. The next day put a protective pipe over it and fill it with 4 bags of fast screed and create a new expansion joint? That's a thousand euros compared to a possible water damage, mold damage of XY €? Or how do you evaluate this?

I am still waiting for the answer from the screed layer to see if he has installed protective pipes there on his own initiative... But I soon fear not...

Unfortunately, I don't have it in writing from the plumber. We had a phone call.

Helpful for me would be a binding and qualified statement on how high the risk is that something will happen or that nothing will happen. And not "we've always done it this way, nothing ever happened."

Anyone who claims something like that should, in my opinion, have no problem confirming it in writing.

Anyone who then looks for excuses not to confirm it in writing becomes suspicious to me, as they are only trying to survive the 4-year warranty period.

Unfortunately, you can't find anything meaningful online about how high the risk is.
