Problems with dormer width in a semi-detached house

Hello friends

I have a small problem. We are building an extension to an existing semi-detached house (each semi-detached house is 7 meters wide). During the entire planning period, a dormer window of 3 meters was planned. A dormer with this dimension can also be found at the surrounding neighbors (same development plan). Not with the direct neighbor.
Yesterday I had a phone call with the architect who pointed out the development plan to me:

"The total width of dormers on each side of the building must not exceed 1/2, the width of each individual dormer must not exceed 1/3 of the building width. The maximum dormer width is set at 3.0 m.
Side gables are permitted with a width of max. 1/2 of the building width. The width of dormers and side gables together must not exceed 1/2 of the building width. The wall height of the side gables and the residential building must be identical. The ridge of the side gables must be at least 1.0 m below the ridge of the main building."

According to this, we would be at a dormer width of 2.30. I wonder how the neighbors did it. All neighbors received building permission through the simplified procedure.
Is it possible that if the dormer extends over two rooms, it is considered as two individual dormers?

Does anyone here possibly have an explanation?

That means your "dormer" would have to be consistently declared as a "side gable" in the building application in order to reach a max. 1/2 wall length = 3.5m. For the professional distinction between a dormer and a side gable, certainly could contribute.

In your pictures, there is in my opinion not a dormer shown at all. A dormer is mounted on the rafters of the roof. I think this is most likely to be called a cross gable and would thus fall under the regulation of secondary gables.

What the neighbors have and how wide it is, cannot be seen here.

It looks the same at the neighbors. I did not really want to photograph other people's houses.

I assume that by "Nebengiebel" a dormer is meant. The dormer differs from the bay window in that it is constructively supported on the outer wall of the floor below, whereas the bay window sits as a roof structure on the rafters. Legally, e.g. with regard to distance areas, a minimum offset from the outer wall of one brick row or 50cm is often required.

"A bay window" is singular, "the surrounding neighbors" is plural. Are there several bay windows in the area for which clearly the same textual provisions apply that do not comply with the provisions?

You will probably have to ask the neighbors that.

How do you know that?
Do you really mean the simplified approval procedure according to §66 or perhaps the exemption procedure according to §67 of the State Building Code?

No.

How old is the development plan? If good reasons come to mind, one can be exempted from the provisions of the development plan. Just ask the neighbors or their design authors.

That does not make answering any easier.

Our property is along a bypass road. For all semi-detached houses along this bypass road, the same development plan applies.
I asked three neighbors about the width of their dormers. The answer was 3 meters.



We are aiming for the exemption procedure. The answer of one neighbor was the "simplified procedure".



The development plan is 12 years old.
I will go to the municipality on Tuesday and ask.
