Full agreement. You should keep things in perspective here. If it is removed again in time, then everything is fine. It was the same in our new development area.

If it was actually simply decided by the builder himself, then it is actually not okay. It is simply proper to ask.

Yes, he is the client. Maybe he is not aware of it and surely he doesn’t know what they are doing on the construction site. But he surely looks over continuously and then he sees it and then he should recognize the mistake (and kindly speak to his neighbor: "Hey, that was not my intention, it will of course be removed again, is it okay if it doesn’t happen immediately tomorrow? What do you think?")

Ah ha.

The scaffolding builders just really messed up at our place and gravel ended up on the street, which the neighbor then cleaned up. When I was addressed about it, all I could say was that I was sorry, that I would clean up the rest, and that I would report it to our construction company so they might say something about it. If I imagine now that my neighbor had come with the regulatory office, the relationship would have been unnecessarily strained right away.

So just try to make contact, but stay calm at first.

Apparently the two have not met yet.
That's why I said that OP and the neighbor probably haven't spoken or introduced themselves yet.
My motto: don't get upset, and keep things reasonable.
If a conversation comes up, you can still point it out with a wink, but please not when there is no reason to cause offense yet.

About the problem. The bigger outrage is building next to the building envelope, if that is really the case. Excavation usually takes care of itself. The other creates facts in the long run.

The thing with the excavation is normal, not a big deal at all. In our notarized contract, it even stated that the plots may be used by neighbors as storage sites for materials before their own use. We did that, it was done for us, and it never caused any trouble anywhere. If you know who is building next door, you inform them when your own construction site will start (round it up by a few weeks ^^) and ask them to please remove (or have removed) their things from there. A good neighbor will also want to avoid falling out with you and will take care of the matter. All of this, of course, assuming you approach it in a friendly and neighborly manner. Anyone who argues over some excavation before construction will really get fed up later. People, be nice to your neighbors! You are building and might never leave there again!
Regarding building outside the development plan: of course, you can ask the building authority. However, they might already be able to assist you here if you post the excerpt of your plot along with the drawn building window of the mentioned neighboring plots here.
