For various matters, an exception may possibly be granted.
So it is not about whether the neighbor builds differently from the development plan, but differently than approved. If you did not sign the neighbor's building application, to my knowledge you should have received a copy of the approval. However, it could of course be that the previous owner of your property signed something there if the building application was submitted before your purchase and you therefore did not receive anything.
Ultimately, only the building authority can clarify...
