I wouldn’t agree to that. Then you’d be chasing the rent for a lifetime.

You can just sue if the amount owed is high enough. Eventually, his house will belong to you too. hehe

We were also allowed to build a technical room on the border (however, to the public pedestrian and bike path). BUT: only if there is no GAS, OIL, pellets or similar inside! So only a heat pump, which we also have, remains. Otherwise, it is rather not approvable because it triggers distance regulations.

But as everyone else here already said. Wall on the border O.K., everything else obviously not. I could even imagine a dismantling there (since it is a severe intervention)? But in case of doubt, a judge will decide based on an independent expert opinion. I would never accept that! No way, never ever. At least compensation. And it probably won't be a good neighborhood anyway if the neighbor is so brazen as to do that without asking? Or was it a preliminary building permit and the builder didn't know anything about it?

Thank you very much for all the responses. This really confirms my sense of justice right now.

The neighbor grants everything individually and partially builds himself. He has no general contractor.
My husband tried to talk to him, but he ignored him and turned on his music. That’s also why we have a lawyer. He has already had confrontations with three other neighbors, but none have been as brazen as with us so far.

The LRA is currently conducting a building law review due to the foundation. With the other one, they just referred us to resolve it privately.

The lawyer stated in his letter the removal of the overbuilt parts, securing the excavation pit (since we found out that we are liable if something happens there on our property! The pit is not secured towards us and there are metal rods sticking out) as well as a ban on entering until they have a permit. He also added a general objection against all further overbuilds.

It’s really unfortunate that a neighborhood starts out like this, but you can’t just accept everything either.
