In such cases, there is only one thing to do: seek a specialist lawyer for construction law and obtain a [Einstweillige Verfügung]. This can then happen overnight, including a construction stop at the neighbor's, if the application is granted. After that, the neighbor will first understand that it is serious for him. The relationship is then, of course, ruined...

I would also be careful here not to create facts that would make dismantling unreasonable. If it were mine, I would try to block access to my land with trucks, excavators, or other vehicles and force a construction stop.

Exactly that is also our concern. Especially since it is already foreseeable that, because the basement insulation runs precisely on the boundary, plaster and edge of the flat roof will no longer find space on his property. We have also communicated this to the [lra] accordingly.
