Moisture behind the bubble foil - where is the error?

Hello everyone!

Our house - we moved in November 2020 - has a relatively high studded membrane around the floor slab (unfortunately, we do not have a basement).
My wife noticed that it is relatively damp behind the studded membrane in some places, see attached photos.

Where is the mistake/what is going wrong here, how did the moisture get there and how do we get rid of it again?

Is the concrete base not sealed at all with bitumen (or whatever that black stuff is called)? Many house providers removed this detail from their standard construction description at some point before 2020, so many builders had to do it themselves unless it was ordered as an additional item.

Does the third photo really show the foundation slab or possibly the insulation of the foundation slab? The plaster facade seems to be at about the same "height." That suggests the insulation, unless you built monolithically...

What kind of soil do you have? The winter was quite wet and maybe the house is now standing in a swamp?

Otherwise, the dimpled membrane with filter fleece was installed correctly with the fleece facing the "earth." For me, the only question is why use such a membrane at all. In the gravel, the water seeps away almost as well as through the filter fleece. With a simple dimpled sheet and the dimples facing the house, there would be at least a little more air between the membrane and the wall.

In the neighborhood, there are rather few houses that have a black base. Some things (like painting the openly visible "sub-roof battens" - oh yes, cornice box?) were offered to us as an option, but to my recollection, not taken.

Here from the "construction description":
"3.3. Sealing and base plaster

    [*]Subsoil insulation between the strip foundations as extruded polystyrene rigid foam, d= 80 mm (WLS 039). Supply and installation of an insulation board d = 120 mm WLG 035 made of Styrodur (or equivalent) in front of the end face of the floor slab and in front of the frost apron. The insulation board is run down from the top edge of the floor slab (corresponding to the bottom edge of the facade insulation) 30 cm - along the end face of the floor slab and the frost apron.
    [*]PE foil above the subsoil insulation in the area of the floor slab as PE-LD, d= 0.25 mm to be supplied and laid overlapping.
    [*]Gray cement plaster on the visible and non-soil-contact part of the house base up to the bottom edge of the facade system to be produced as sealing plaster according to requirements for splash water protection.
    [*]Production of the horizontal barrier for the story masonry according to DIN 18533 below the first stone layer."

Good question what the photo actually shows.
You mean the photo where I pull back the dimpled membrane far, where you can still see a hairy piece of the dimpled membrane to the left in front of the window sill of the outer windows?
At least there is no further layer underneath - or we have not found any so far...
