Hello everyone,

we have a building with rubble stone walls that is to be demolished. The walls on the property boundary will then be shortened to just above ground level and provided with a ring beam (done by a construction company). On top of that, it will be rebuilt with shuttering blocks to maintain the familiar exterior appearance and privacy.

The wall is supposed to have a height falling from 360 to 250 over 8m (on the slope), then the same length around the corner with about 100 height.

I suspect that building the wall of that dimension is no longer suitable for DIY without experience?

I would also be interested in the legal aspect of such a wall (the federal state is Rhineland-Palatinate).

[*]The wall continues the still existing gate wall (old farmyard), the structure I would definitely interpret as typical for the area (old town center, many (former) farms). It is lower and in the same place as the currently existing outer wall of the building to be demolished
[*]The street at this point is 5.60m - 6.40m wide
[*]All buildings on the street are built directly on the street, there are no front gardens or similar.

In the state building code §8(8) there is the sentence "Without own clearance areas and in the clearance areas of buildings, enclosures and retaining walls up to 2 m height are permitted, in commercial and industrial areas without height limitation." Here these are exceeded. At the narrowest point the street is also not wide enough to accommodate the minimum clearance area of 3 m. Can this wall still be permissible?

I have attached a sketch from the street view.

That sounds to me like classic Eulenspiegel nonsense, because:

It seems more obvious to me to only dismantle the gable or reduce this external courtyard wall of the building to the height on the other side of the gate wall. I do not see the legal protection of the wall expire solely because it may lose its partial function as a house wall. In case of doubt, an agreement should be reached on this, the lawyer will clarify. I consider the described demolition execution a planning error.

Your suggestion was also the solution that we initially had in mind.

The plan to demolish and rebuild came about in conversation with the company from which we requested a quote for the demolition. The reason given was the difficult-to-assess stability of the existing rubble stone wall, which would then be deprived of two stabilizing walls and the concrete slab of the adjacent crawl space. On the inside, the height would be continuously 3.60 (recording the courtyard height).

Additionally, the demolition would be cheaper because more heavy machinery can be used.

The issue of existing rights did not come up there, which could shift the consideration once again.

We are now looking for an architect on site anyway due to another issue. Hopefully, he will be able to competently answer whether rebuilding the wall is legally possible or suggest another option.

The question is how quickly someone can be found :) In this respect, I would also appreciate further assessments here.

Could someone perhaps move this topic to the building law section?
