I wouldn't willingly invite trouble ;) With private individuals, it might be different; however, only if they want to save money on smart advice. Rhineland greetings

Therefore, my advice is that, as the seller, I would have the notary hired by the buyer... :rolleyes:

The choice of notary is free. However, it is customary that the buyer chooses the notary. Make use of this!

One should choose - also in other matters - the notary they trust. Even though the notary is obliged to be neutral, wouldn’t one feel better with "their" notary?!

Then someone should quickly recommend to the Verband Privater Bauherren to review their website and its content. The statement "whoever buys chooses the notary" is incorrectly presented in such a shortened form, as there is no legal basis for this statement ;)

Basically, it is not presented in a shortened form. Apparently, the Association of Private Builders also writes the words "is free" and "common practice is". Who needs more restrictions? ;)

If the seller commissions a contract with "their" notary and the seller is also the reason the deal falls through - but doesn't want to sign - what do I as the buyer have to do with the notary and their invoice? After all, the seller commissioned the contract preparation.

If the contract is concluded, of course, it's different, then all costs are borne by the buyer.
