Hello,

Thank you very much for your extensive answers and also discussions. To be clear, I will present everything completely normally and openly, without hiding anything etc... It’s not worth it to me.

But now I have two more questions......

First question: My seller was gifted the piece of land in 2008, now he says that he must observe a 10-year period before the sale. We really don’t know where this statement comes from, can anyone make sense of it?!?!
It has something to do with leasehold etc. He is registered as the owner of the parcels in the usual way.

Second question: Since it is grassland, the farmers there have a pre-emptive right. In other words, as the seller, he probably has to register this with the [Landvolk], and then any farmer there can make claims that they want to have the piece of land, and I end up looking stupid.

Wow, does anyone know about this, or do I possibly have to open a new question here.

The pre-emption right for farmers must be a special feature of your federal state. I am not familiar with it here. The 10-year period is important. Whoever acquires land and sells it for a profit within 10 years has to pay tax on that profit. If he owns it for 10 years and one day and then sells it, the profit is tax-free. Karsten

All right, so he "only" has to pay taxes, but in principle he can sell it at least before the deadline.

Maybe he still has another shackle on his feet from the donor back then? A prohibition on disposal within the first 10 years? For whatever reason?

Hi,

So it is stipulated in the Grundstücksverkehrsgesetz. Thus, from 1ha approval is required.

There is supposed to be a new law soon in Lower Saxony, NSAG, which still provides for the 1ha limit.
