These are just standard clauses that municipalities or large development contractors have. Here in the new development area, the city also appointed the notary; with the number of parcels, it would be crazy if every buyer chose a notary. Especially since there were also a few special conditions to note here. However, changes were still possible (and important to me because some things were too vague). Liability exemptions are normal with municipal properties, it was the same in my family. That cannot be changed.

That sounds like a standard clause and does not exactly speak well of your advising lawyer... if it is a development company, they usually have no problem if you suggest a different notary.

The notary is also not responsible for drafting the contract, the notary only ensures that you understand what you are signing.

And when it comes to surprises in the ground, it helps to find out what used to be there, where it was, and what might be lying there. It also helps to get information from the utility providers, such as gas, water, sewage, telephone, copper, fiber optics, and whatever else is underground in the region. Things like old aerial photos can also help (bombs, bunkers, old buildings) but do not provide 100% certainty.

One must pay attention to two things. Description of the property honestly. Then I can also accept exemption from liability because I was told what could be the case. Whether it is like that on my parcel can be checked by inspection. Payment from me to the seller only when the property can be transferred to me free of encumbrances. That means that after the payment has been made, the competent district court can register me as the owner without a special case or anything else. Karsten
