That's ridiculous. A few centimeters more perimeter insulation or a modern window profile and you're over the limit, if they can't calculate it smaller anymore.

I am very pleased if I am wrong with my fears regarding you as a victim of real estate sales preachers. My doubts about the naivety of the concept remain (hopefully understandable). What do you want with a facing brick on a rental property in this housing size class? - it is not needed there, or relevant for turning a residential unit on the market faster - except maybe if we are talking about Bogenhausen or Sylt.
