KFW grant applied BEFORE notary appointment

Hello dear ones,

What is happening right now is really crazy.
Until yesterday, I thought we were on the safe side regarding the 461 subsidy for our energy saving ordinance 40 EE house.
But now I read that we submitted the application too early.
The approval for our plot came in September on 20.09.21, after which we chose the house provider, with a clause in the contract for the KfW subsidy.
So far, so good.
The energy consultant then sent us the confirmation for the application (BZA), with which I then applied for the subsidy after consulting with our banker and immediately received the approval.
Immediately afterwards, the final financing was set up, and the land charge was entered in the land register.
The notary appointment was on 10.1.22, I applied for the 461 on 8.12.21.
How else should I do it, our financing is based on the NRW.Bank and KfW Bank.
How am I supposed to buy the plot first and then do the financing with NRW.Bank if they only become active once KfW has approved?
Now I am afraid that if I apply for the payment after completion of the construction, the KfW Bank will say, no, that won’t work. We won’t pay.

Has anyone by chance already had experience whether it is really checked exactly since when you are registered in the land register?
Probably very few houses are finished yet, so there are only few experiences, right?

We paid special attention to everything, we thought.
KfW clause in the contract etc.
It can’t be that neither the bank nor the energy consultant nor anywhere else said we must first be registered in the land register.

I am really desperate.

Of course, KFW is applied for BEFORE the note appointment.
It is not a problem. You just should not have started building yet.

That is not entirely correct. The KfW states the following:


Whether it is checked, however, is another matter.

I thought so too until yesterday.
But now it is said that you have to have been the owner BEFORE applying.
I'm really confused.
My banker said I shouldn't worry, that this is hardly feasible in sequence and NRW.Bank sees it that way too. But does the KFW Bank see it the same way?

Hello, have you already received an interim status from [Kfw]? The funding has been discontinued.

Did you have a priority notice of conveyance in the land register?
