Is an air-to-water heat pump sensible for renovation as an efficiency house monument (160% Energy Saving Ordinance)?

In case of rental due to the danger of "overclocking" through improper use of the ERR by the tenant, I would nowadays no longer recommend a heat pump either. But I am just a well-read layperson and have no real experience, let alone training.

The ERR is legally required. An exemption is theoretically possible, but as far as I know, no successful implementation without ERR has been reported here in the forum. You can technically deactivate the ERR in practice by removing the actuators from the distributor. Whether this is legally permissible under rental law, I dare to doubt.

As a small clarification, what exactly is the problem with the ERR? Do I understand correctly that the problem is that the individual rooms are regulated too low so that the valves for the rooms close and the heat accumulates at the heat pump causing it to shut off and wear out due to frequent switching on and off? Adjusted behavior would therefore be to heat strongly in one room so that it always runs?
