Ah ok. So you dumped your topsoil on someone else's property?

Whether there is a picture or not, if they report you, you will probably be "at fault."

On a protective embankment. The guilt of hauling away a cartload of topsoil is undisputed. My question is whether he can photograph me at the "Corpus delicti." Or not even that—the cart was already empty.

He can also take pictures of you naked in the shower, but he is simply not allowed to do that! (Unless he has your permission)

He can report you with or without a photo, but if he shows the photo as "evidence," it will of course not be accepted and you can report him.

So just wait and see, if something comes, pay your 30€ and then you just report him!

Unfortunately, none of this is correct. Just look up 201a StGB. Basically, it is only forbidden to publish pictures, or to photograph protected areas, or to damage someone's reputation this way. If he made the recordings during your act, he documented an administrative offense that can be used against you as evidence... All in all, actually not worth mentioning. A bad basis for a neighborhood. For all those who are now wrinkling their noses: According to the false prevailing opinion, no one would be allowed to take any vacation photos showing other people anymore. But as a little anecdote, as soon as they are shown at events with more than 5-10 participants (wedding, 60th birthday, etc.), they count as published.
