Increase knee wall height - exceed eaves height?

Hello everyone,

thank you very much for your responses. So from the Bauamt Berlin Neukölln we have received the following information:

Behind the 20 m building depth, construction is exceptionally permitted under the following hinterland conditions:

· Only for residential use
· Detached single-storey residential building with a developed attic for residential purposes (when applying the Baunutzungsverordnung 68, rooms in the attic are counted towards the floor area)
· Distance of the gable to the neighbor's boundary >4m, in front of the side wall >3m
· Dormer < 1.5m high but <1/3 of the roof height, length <1/2 of the ground floor wall
· Outer edge >0.5m set back compared to the ground floor wall
· The eaves-side wall height <4m (established ground level up to cut line: outer wall surface – roof surface) and the ridge height <8.5m above terrain
· 1 parking space or garage on the hinterland

In principle, we would like to build the same house in terms of dimensions as the one on the front property, with an additional flat-roofed gable on the street side and a flat-roofed dormer flush with the ground floor wall on the back.
The existing house has a ridge height of 8.10m and an eaves height of 4.30m. We have also "discovered" additional gables facing the street on two other houses built in the second row on this street.

In the children's room, the negligible loss of space may be true, as these areas can be used for storage. However, the bedroom and the bathroom cause me more concern in this regard.

Do you have to position the bed that way necessarily? Perhaps you could also swap the bedroom and the dressing room? Then install a wardrobe along the entire wall length in the dressing room. Photo attached.

I don't actually see any problems with the bathroom. With the right ideas when building up walls, you can make it really nice. Just search for "bathtub under sloping roof." Maybe you can also build a niche directly into the wall. Photo also attached... There are definitely enough ideas. The shower under the sloping roof would also be an idea... I wouldn't worry too much about it.

Regarding the children's room, the ideas have already been described. That's how we'll do it as well.

Without knowledge of the ground floor, this is more difficult to assess. What are those approx. 40 cm long projections of the gable walls?

In principle, exceptions to statutes should be as possible as exceptions to development plans. Would it be possible to "bury" the house?

I consider placing a knee wall in front of the knee posts to be the greatest nonsense: a Pyrrhic victory that throws the baby out with the bathwater when you drive out the devil with Beelzebub.

Well, if the neighbor is at 4.30m, then the matter is practically already approved. I would still push the limits here. Bury the foundation slab, ceiling height 2.65m + ceiling 25cm = floor height 2.90m. 4.30m - 2.90m = knee wall 1.40m. Theoretically.

I think including the existing buildings of the first row in the integration definition of the construction projects of the second row in the densification of the development area will not work.

On what legal basis are these information founded? To me, this sounds like extracts from a development plan and a design statute. Where else should the reference to the Baunutzungsverordnung 68 come from?
Did you receive the information specifically for your property, or is it only of a general nature?

Who determined the terrain surface? Where is the determination documented?
Who planned for you? A local architect? Have the planning law basis explained to you in detail by the draft author.
