How do you justify an exceedance of the ridge height?

Hello everyone,

I urgently need help/tips on how to justify in writing a ridge height exceedance to the building authority so that it gets approved. We are at our wit's end :confused:: In the development plan, the ridge height is set at 8 meters, measured from the middle of the house and the natural terrain level. We have a sloping plot, and the plan is for a house with 3 floors; we want to live on two floors and rent out one floor. According to the architect's calculations, we are about 0.75 m above the ridge height. Do you have any ideas/templates on how to formulate a justification for approval?

We live in Hesse and want to build in Gudensberg.

Hello neo,

Development plans are not created to be circumvented, but so that they are adhered to. Or would you like it if a 12-meter-high apartment building with 10 units was built next to you? Before starting to plan, the development plan is known and must be observed accordingly; unfortunately, we do not know here either why your architect does not comply with it and has no idea how to justify the changed ridge height.

so I hope that is not approved.. I would appreciate it if we do everything to achieve heights and other things or make it look good and then my neighbor comes and ruins everything for me.. no no.. for something like that, as mentioned above, there are zoning plans.

that does not mean, however, that one cannot get exceptions approved.
I was recently amazed at how easy that is possible,
even without a big justification.

Development plans usually have a purpose, and it certainly makes sense to set building heights and ensure compliance.
