What does he gain from it? As described above, he comes out without profit in both cases. Now that we are close to the purchase, of course he doesn't want to let us down and now backtrack.

I don't have to free myself from that thought, we are not stupid either... there really are "super bargains" when someone in the circle of acquaintances is in financial distress and has to sell!! As someone who does not know the property and the price, one cannot evaluate that, but that was not asked either...

Yes, that was also my thought.. However, according to the deed, the municipality could claim the increase in value of the property, since the market value has risen in the 5 years since the property was acquired.
As you rightly say, he doesn't make any profit from it, so hopefully the municipality will overlook that..

Yes, a rent-to-own agreement has also occurred to us, but that would be somewhat complicated tax-wise, especially since we plan to invest more money in the property.

But if there is no other option, that would indeed be a possibility we should consider.
Do you perhaps know if the seller would also have to declare the income as a landlord in this case?

The wife no longer has any rights in this case and is no longer registered in the land register. They divided everything after the divorce (like I don’t know how). But she has nothing to do with the house anymore..

Stop, slow down, don’t mix everything up. There is the municipal council. Their interest, with the discounted plots, is that no land speculation should be conducted. This is not the case here, it is a distressed sale. Since no municipal council member wants single-family homes, they are keeping quiet.
Assumption of his financing. Ok, if priced in, it saves him a prepayment penalty.
Notary contract, forget this notary. He will only be able to certify once he knows for sure that the municipality will not make him pay.
Right of first refusal ex wife I do not see. It sounds like he paid her out. Anyway.
Purchase price level can only be judged by someone who knows your market. Not possible from a forum.
And yes, if someone has to tread on the land, I don’t have to as well. A good deal is such a distressed sale, even if one is fair in it. K.
